Additional Product and Feature Terms
When you use HASH, you agree to the following terms of use, which form part of the original agreement you or the organization, company, or other entity that you represent have with HASH, that links to or otherwise references these Additional Terms (the “Supplementary Agreement”).
Capitalized terms used but not defined in these Acceptable Use Policies have the meanings assigned to them in our General Terms of Service or Corporate Terms of Service, as applicable. For customers subject to the Corporate Terms of Service, "you" and "your" refer to "Customer" or "Users". "We", "us", and "our" refer to "HASH".
1. General Product Terms
The following may apply to any Customer or User of HASH.
A. Competitive Benchmarking
If you offer a product or service competitive to any HASH product or service, by using that HASH product or service, you agree to and hereby waive any restrictions upon HASH as to the competitive use and/or permissibility of benchmark testing that may exist in the terms governing your competitive product or service. If you do not intend to waive such restrictions in your terms of use, you are not allowed to use that HASH product or service.
B. Telemetry
HASH products and services may, depending on your preferred telemetry settings, collect environmental and usage information. This may include personal data, as referenced in the HASH Privacy Statement.
C. Previews
Previews means software, online services and additional products and features provided for preview, evaluation, demonstration or trial purposes, or pre-release versions of those, such as alpha, beta, or early access. If your Agreement does not include terms and conditions that address Previews, then the following terms apply. HASH grants a limited right to use a non-production instance of the Preview. Previews are provided “AS-IS”, “WITH ALL FAULTS” and “AS AVAILABLE”. HASH may change or discontinue Previews at any time without notice. Any information we give you about a private Preview will be considered HASH's confidential information. If you choose to provide comments or suggestions about a Preview, we may use that feedback for any purpose without obligation of any kind. HASH's maximum liability is limited to direct damages up to US $5,000. HASH has no obligation to defend, indemnify, or hold you harmless for claims brought by third parties arising from your use of Previews.
D. Availability
HASH reserves the right at all times to reclaim any HASH subdomain or website path without liability.
2. Supplementary Terms for Credits
Certain paid features and functionality accessible via the Service may be metered, with “Usage Charges” levied for their use.
Ordinarily, Usage Charges are paid through the advance purchase of Credits. However, at HASH's sole discretion, and depending on your Account age, billing history, and a number of other factors, you may accrue Usage Charges in arrears based on actual usage levels observed (above the included entitlements in your Subscription License Term or other commercial Agreement with HASH).
A. Kinds of Credits
Credits can be used to offset Usage Charges accrued.
“Credits” collectively refers to:
→
Service Credits. Unless otherwise agreed, we may require you to pre-pay for certain Services by purchasing credits sufficient to cover your usage according to our Pricing page and these Supplementary Terms, as may be updated from time to time (“Service Credits”). Your order for Service Credits constitutes an offer by the same to purchase those Service Credits. We will notify you if we accept your offer of purchase (the "Confirmation Notice"). These Supplementary Terms for Credits will become effective when we send the Confirmation Notice.→
Free Credits. We may, in our sole discretion, offer you free credits as part of a promotion or during sign up for the Services (“Free Credits”).→
“Other Credits”. From time to time, we may offer other types of credits, under terms that differ from those which standard Service Credits and Free Credits are made available under. These Other Credits may come with alternative terms, or specific restrictions, which will be stated clearly at the point of issuance, which may limit their scope of use (for example, the exact Credit-Based Services or External Services against which Other Credits may be redeemed).
B. Restrictions on Credits
Non-Refundable. All Credits issued, which includes Service Credits, Free Credits and Other Credits, are non-refundable.
Non-Fungibility. Credits are not legal tender or currency of any kind and have no cash value.
Non-Transferable. You may not transfer or sell any kind of Credits, nor attempt to transfer or sell any kind of Credit, to any other person or entity.
Expiry. Service Credits expire one calendar year from the date we send the Confirmation Notice or otherwise issue the Credits. Free Credits expire at the time indicated when issued (or otherwise one calendar year from when issued if no time is specified). Credits will also automatically expire if you close your (or your organization's) Account, and in such cases Credits cannot be recovered.
Usability. Credits may only be used by the holder of the Account with which the Credits are associated.
C. Maintaining a Credit Balance
Credit Balance. You can check the number of Credits associated with your Account, or any Account you are authorized to access, on the relevant Account's Billing page.
Balance Maintenance Service. You may have the option to automatically reload Service Credits by a certain amount (“Balance Maintenance Service”) when your Credit Balance reaches a certain level, which you may set during onboarding, or from the Billing page of your Account. When the Balance Maintenance Service is active, you authorize HASH to charge the payment method designated in your Account on a recurring basis for the applicable fees and taxes for the amount of Service Credits added to your Account as part of the Balance Maintenance Service, until you opt out of the Balance Maintenance Service. Except where otherwise stated or agreed, all Credits added to your Account as part of the Balance Maintenance Service will be charged on or around the day on which the Credits are added to your Account.
3. Additional Products and Features
When you use HASH, you may be given access to additional products and features ("Additional Products and Features"). Because many of the Additional Products and Features offer different functionality, specific terms for that product or feature may apply in addition to your main agreement with us—the HASH Terms of Service, or HASH Corporate Terms of Service (each, the "Agreement"). Below, we've listed those products and features, along with the corresponding additional terms that apply to your use of them.
By using the Additional Products and Features, you also agree to the applicable HASH Terms for Additional Products and Features listed below. A violation of these is a violation of the Agreement. Capitalized terms not defined here have the meaning given in the Agreement.
